Welcome to StaceysStyle.com, a website of Stacey’s Style, LLC. These Terms of Service (“Terms”) govern your use of our website (the “Site”). By accessing or using our Site, you agree to be bound by these Terms. If you do not agree, you must stop using the Site immediately.

  1. Definitions
  • “User,” “you,” or “your” means any person accessing or using the Site.
  • “Content” means any text, graphics, images, audio, video, data compilations, software, or other information appearing on or forming part of the Site.
  • “Stacey’s Style,” “we,” “us,” or “our” refers to Stacey’s Style, the owner and operator of the Site.

You must be at least 18 years old to use the Site. By using the Site, you represent and warrant that you are at least 18.

  1. Intellectual Property & Brand Disclaimer
  • Stacey’s Style is not endorsed by, sponsored by, or affiliated with any of the brands displayed on our Site. All brand names, logos, and trademarks remain the property of their respective owners. We use these brands and trademarks solely to identify the products we sell, as permitted under applicable law, including the doctrine of nominative fair use.
  • All photographs, descriptions, text, graphics, and other content on the Site are created by Stacey’s Style and constitute our proprietary materials, or are otherwise used with permission.
  • You may, for personal and non-commercial use only, retrieve, display, and view Content on your device. You may not otherwise reproduce, modify, copy, distribute, transmit, or use any Content without prior written permission from Stacey’s Style.
  1. Prohibited Use

You agree not to use the Site in any way that:

  • Causes, or may cause, damage to the Site or interferes with any other person’s use of it.
  • Is harmful, unlawful, illegal, abusive, harassing, defamatory, threatening, or otherwise objectionable.
  • Involves making or transmitting unauthorized electronic copies of Content.
  • Attempts to gain unauthorized access to the Site or its systems (including scraping, bots, or automated access).

Our Site may contain links to third-party websites. Unless expressly stated, these sites are not under our control. We assume no responsibility for the content of such sites and disclaim liability for any loss or damage arising from your use of them.

  1. Authenticity Disclaimer

Stacey’s Style is an independent reseller of pre-owned and vintage designer items. We are not affiliated with, endorsed by, or sponsored by any of the brands whose products appear on our Site. All trademarks remain the property of their respective owners.

  1. Availability of the Site
  • The Site and any online facilities, tools, or services are provided “as is” and “as available.”  To avoid technical conflicts for the purchase of items, the Site may be unavailable routinely during Stacey’s Style IG Lives (@staceysstyle32) which often are at Noon Eastern time on Sundays.
  • We do not guarantee that the Site will be secure, error-free, or free of viruses or malware. You are responsible for protecting your own devices.
  • We may alter, suspend, or discontinue the Site (or any part of it) at any time without notice.
  1. Disclaimer of Warranties

To the fullest extent permitted by law:

  • We make no warranties, express or implied, regarding the Site, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • We do not warrant that the Site will meet your requirements, operate without interruption, or be error-free.
  1. Limitation of Liability

To the fullest extent permitted by law:

  • Stacey’s Style shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • Our total liability for any claim arising from your use of the Site shall not exceed the greater of (a) the amount you paid us for the relevant product, or (b) $100.
  • We are not liable for events beyond our reasonable control (including shipping delays, strikes, acts of nature, or third-party failures).

You agree to indemnify and hold harmless Stacey’s Style and our owners, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site or violation of these Terms.

  1. Privacy & Cookies

Use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

  1. Governing Law & Dispute Resolution
  • These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law rules.
  • Any disputes shall be resolved through binding arbitration in Franklin County, Ohio, on an individual basis, and not as part of a class action. You waive the right to a jury trial.
  1. General Provisions
  • No Third-Party Rights: These Terms are for your and our benefit only. No third party has the right to enforce them.
  • Assignment: You may not transfer your rights under these Terms. We may transfer ours if we reasonably believe it does not materially affect your rights.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • No Waiver: Our failure to enforce any provision does not waive our right to enforce it later.
  • Entire Agreement: These Terms, together with our Privacy Policy and Cookies Policy, constitute the entire agreement between you and Stacey’s Style regarding your use of the Site.
